Terms of Use
1. Acceptance of these terms
These terms form an agreement between you and Omnuvar governing your use of this website and the trading platform. By using either, you accept them. If you do not accept them, do not use the service.
2. Eligibility
You must have reached the age of majority in your province or territory of residence — eighteen in Alberta, Manitoba, Ontario, Prince Edward Island, Quebec and Saskatchewan, and nineteen elsewhere in Canada. You must be acting on your own behalf, be able to enter a binding contract, and not be resident in a jurisdiction where use of the service would breach local law.
We may decline to open an account, or close one, where eligibility cannot be verified.
3. What the service is
Omnuvar provides technology: analytical models that assess market data and execute orders according to parameters you configure. It is an execution tool, not an advisory relationship.
Omnuvar is not registered as a dealer, adviser or investment fund manager with any Canadian securities regulator. Nothing on this site or produced by the platform is a recommendation, an opinion on the suitability of any instrument for you, or advice of any kind. You are responsible for every decision made on your account, including the decision to enable a model.
4. Acknowledgement of risk
Trading digital assets and contracts for difference carries a high risk of loss. Prices are volatile and can move sharply against a position. Leverage amplifies losses as readily as gains. You may lose the entire amount you deposit.
Modelled results, historical figures and the projection tool on this site are illustrations produced from past data. They are not forecasts and they do not indicate what any account will do. You accept these risks when you trade.
5. Your account and responsibilities
You are responsible for the accuracy of the information you give us, for keeping your credentials and second factor secure, and for every action taken on your account. Tell us promptly if you suspect unauthorised access.
Accounts are personal. You may not permit anyone else to use yours, and you may not open more than one account without our written agreement.
6. Acceptable use
You may not use the service to launder money, finance terrorism, evade sanctions or commit any other offence; to manipulate a market or engage in abusive trading practices; to interfere with the platform's operation or security; to extract data by automated means without our permission; or to reverse-engineer any part of the system.
We may suspend or terminate access immediately where we reasonably suspect a breach of this section.
7. Fees
Charges consist of a spread applied to each executed order and, for leveraged positions, financing rates on the published schedule. The applicable schedule is presented before you confirm your first order and is available in the platform at any time. Third parties may impose their own charges on funding or withdrawal, and those are outside our control.
8. Intellectual property
The platform, its interface, the models and the material on this site are owned by or licensed to Omnuvar and protected by Canadian and international intellectual property law. The Omnuvar name and mark may not be used without our written permission. You receive a personal, non-transferable, revocable licence to use the service for its intended purpose, and nothing more.
9. Limitation of liability
To the fullest extent the law allows, Omnuvar is not liable for trading losses, lost profits, or indirect or consequential damages arising from your use of the service, including losses caused by market conditions, interruptions in connectivity, or the acts of third-party venues and payment providers.
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud. Some provinces do not permit the exclusion of certain warranties or of liability for certain damages; where that applies to you, the exclusions above apply only to the extent permitted in your province.
10. Governing law, changes and contact
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, and the courts of Ontario have jurisdiction over any dispute, without prejudice to any right you have to bring proceedings in your province of residence under consumer protection legislation.
We may amend these terms. Changes take effect when posted here with a revised date above, and continued use of the service after that constitutes acceptance. Questions go to [email protected].
